TERMS OF SERVICE

Welcome to Blinked. These Terms of Service (“Terms”) govern your access to and use of Blinked’s websites, applications, and services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Overview of the Service

Blinked provides tools for creators (“Sellers”) to upload and manage digital content and generate secure, expiring links using Blinked’s mobile applications. Content is distributed to customers (“Buyers”) on Blinked’s web experience, where buyers may purchase access and view content. The iOS application is a seller-facing tool and is not used by buyers to purchase or consume content.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service and legally capable of entering into a binding agreement.

3. Accounts

You are responsible for maintaining the security of your account and all activity that occurs under it. Blinked is not responsible for unauthorized access caused by your actions.

4. Seller Content

Sellers are solely responsible for the content they upload or sell and must ensure they have all rights required. Prohibited content includes illegal material, infringing content, malware, or violations of payment-network rules. Buyers may report content on Blinked’s web experience if they believe it violates these Terms or Blinked’s Community Guidelines. Reported content is reviewed and may be removed, and seller accounts may be suspended or terminated where appropriate.

5. Payments and Payouts

Payments are processed by third-party providers such as Stripe. Blinked does not store full payment card information.

If a Seller has not connected a payout account, funds may be held by Blinked until payout setup is completed. Blinked does not guarantee payout timing.

6. Refunds and Disputes

Digital purchases are generally final. Refunds are issued only where required by law or at Blinked’s discretion. Abuse or chargebacks may result in account suspension.

7. Intellectual Property

Blinked retains all rights to its software, branding, and services. Sellers retain ownership of their content but grant Blinked a limited license to host and deliver it.

8. Service Availability

The Service is provided “as is” and “as available.” Blinked does not guarantee uninterrupted access or error-free operation.

9. Limitation of Liability

To the maximum extent permitted by law, Blinked shall not be liable for indirect or consequential damages. Total liability shall not exceed amounts paid to Blinked in the preceding 12 months.

10. Termination

Blinked may suspend or terminate access at any time for violations of these Terms or misuse of the Service.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Blinked is incorporated, without regard to conflict-of-law rules.
